Terms and Conditions of Use for iHunt.ro Website

1. Definitions
1.1. In this document, the following terms used in uppercase shall have the meanings specified below unless otherwise indicated by the context:
REGISTERED TRADEMARKS: represent the registered trademarks of S.C. iHunt Technology Import Export S.A., such as, but not limited to, the name iHunt.
WEBSITE: represents the iHunt website located at www.iHunt.ro, through which the USER has access to information regarding the services and products offered/provided by iHunt.
iHunt: represents the company S.C. iHunt Technology Import Export S.A., headquartered at Str. Rahovei nr. 2, 2nd floor, Ploiesti, Prahova, registered with the Prahova Trade Register under no. J29/330/2015 and having the Unique Registration Code 34184455, fiscal attribute RO.
USER: represents the person who accesses the WEBSITE, for private or professional purposes, and who has accepted the TERMS AND CONDITIONS of this WEBSITE, fulfilling all the registration process requirements accordingly;
ABUSIVE USE: represents the use of the WEBSITE in a manner contrary to industry practices, regulations, and current legislation or in any other way that may cause harm to iHunt.

 2. Website Content
2.1. The information published on the WEBSITE is general information about iHunt, its products, those of its partners, as well as other information considered by iHunt to be of interest to USERS.
2.2. The information is usually provided to USERS free of charge. iHunt reserves the right to implement certain services on the WEBSITE that will be offered for a fee to USERS.
2.3. iHunt is the holder of all intellectual property rights over the WEBSITE, including its design and content, as well as over all Registered Trademarks.
The USER is obliged to respect all intellectual property rights of iHunt, as provided by the current legislation.

 3. Website Use
3.1. The USER undertakes to access and use the WEBSITE for purposes and by means that do not constitute abusive use.

 4. Limitation of Liability S.C. iHunt Technology Import Export S.A.,
4.1. Liability for WEBSITE content. iHunt is not and cannot be held responsible for damages caused by errors, inaccuracies, or non-updating of information published or maintained on the WEBSITE, which are not due to its fault.
4.2. In case prices or other details regarding products/promotions have been incorrectly displayed, including due to being incorrectly entered into the database, we reserve the right to cancel the delivery of that product and to inform the customer by phone/email as soon as possible about the error, if the product has not yet been delivered.
4.3. The characteristics of the products presented on the WEBSITE are taken over/provided by manufacturers and suppliers, and iHunt does not assume responsibility for the accuracy of this information.
4.4. The prices of the products on this WEBSITE are informative and are subject to change without notice. The promotions presented on the WEBSITE are valid for the specified period of time / if no period of time is specified, they are valid within the limits of available stock. All products presented on this WEBSITE are available within the limits of the available physical stock. In case of stock depletion, the iHunt representative will offer alternatives by presenting other products similar in appearance and technical specifications to the ordered product whose stock has been depleted.
4.5. Additionally, the images presented on the WEBSITE are for illustration purposes only, and the delivered products may differ from the images in any way, due to changes in characteristics, design, without prior notice from the manufacturers.
4.6. A pre-order product is a product that is not physically in the online store's stock, it is to be brought and can be purchased before the date displayed on the WEBSITE. By making a pre-order, you ensure that you will receive the product immediately after it is brought into physical stock and that you will benefit from a very good price. Pre-order products will be shipped on the day they are brought into stock. Pre-orders are paid for in the same way as a regular order, through any of the accepted payment methods. In any situation (cash on delivery or online payment), it is necessary to wait for the telephone or email confirmation from an operator when the product becomes available. You can cancel a pre-order at any time. If it has already been paid for, you can choose to refund the amount or credit your account for another order.
4.7. Product Warranty - The purchased products benefit from a warranty of 12/24 months for legal entities/individuals based on the invoice and the original warranty certificate. Phone batteries/external/internal batteries benefit from a 6-month warranty, being considered consumables.

The product is returned by Cargus or any courier delivery service to the address, which offers the possibility of tracking the uniquely identified package. The transportation cost will be borne by iHunt only through the standard delivery of the agreed Urgent Cargus courier.
All products sold through our website are new, equipped with all original accessories. Since the products are important from outside the EU, during import customs operations, the products may be unpacked for inspections in accordance with the current legislation. This process is normal for all products imported from outside the European Union and does not pose any risk to the consumer. The products are new, unused, and without functional or aesthetic problems.
Additional Service: For any product purchased from iHunt.ro, you can opt for the Parcel Inspection service.
The following situations lead to the loss of warranty: traces of liquid contact inside the device, traces of mechanical shocks - hits/scratches, cracked display or touchscreen, use of improvised or unauthorized accessories by the seller, unauthorized intervention on the device's software (IMEI deletion, resofting, changing the operating system to another version), unauthorized intervention by unauthorized persons inside the product, triggering of shock / water sensors in the phone. If any of these things are observed, the product will be returned to the customer and the warranty will be canceled.
Products flagged in the Antishock, Water Resistant, or Dust categories are subject to the same terms and conditions. These products benefit from additional properties and functionalities that can provide increased protection in case of accidents, compared to common equipment, but they are not indestructible.
The warranty resolution period varies from case to case and does not exceed 15 days (if parts that are not in stock in Romania are needed). During the warranty period, the average resolution time for warranty-related issues is 3-10 business days.
Products with physical defects such as: hits, cracks, chips, burnt or cracked components/parts, damaged warranty labels or seals, products used in inadequate conditions (inappropriate power supply voltages, exposure to large temperature and pressure variations, mechanical shocks, incorrect handling, use of products in conditions of humidity, dust, noxious substances or under the action of chemical substances, etc.), incorrect settings and installations, ungrounded sockets, entry of liquids, metals, or other substances into the equipment, mechanical or plastic intervention on the products, connecting or disconnecting certain components during equipment operation, are not covered by the warranty.
ATTENTION! Phones sent for warranty must not contain personal data or be password protected. Otherwise, the phone will be returned to the customer for proper sending.
4.8. Unilateral Termination of the Contract
The return of products is accepted according to the terms and conditions mentioned below and is in accordance with the provisions of O.U.G. 34/2014 regarding the rights of consumers within contracts concluded with professionals, as well as for the amendment and completion of some normative acts:
Products subject to online orders can be returned within 14 days from the date of receipt; before the expiry of the withdrawal period, the consumer has the right to withdraw from this contract within 14 calendar days from the day of product delivery. Return costs are borne by the consumer. We recommend keeping the original packaging to protect the integrity of the products. Products that are not properly packaged will not be accepted.
The returned product must be in the same condition as it was delivered; the consumer is only responsible for the decrease in the value of the products resulting from their handling.
Product returns can be made by sending the products through a fast courier company, according to the instructions in the Warranty Certificate, together with the original Warranty Certificate (with the completed form and the bank account of the person from the invoice) and a copy of the invoice.
Exceptions to the right of return are listed for example, without limitation, to the following (according to art. 16 OUG 34/2014):
a. Software licenses (this category includes products with pre-installed systems);
b. Products made to the consumer's specifications or clearly personalized;

 

The withdrawal period for individuals is 14 calendar days.
The withdrawal period for legal entities is 3 calendar days.
Refunds for legal entities will only be made by bank transfer, regardless of the initial payment method, within a maximum of 30 days from the receipt of the return.
Upon receiving the package and assessing the initial condition of the product, the sale will be canceled, and the money will be refunded to the buyer.
Packages sent with cash on delivery for refund purposes will not be considered.
iHunt reserves the right to complete and modify any information on the SITE.
Any issues arising from the products and/or services presented on the SITE will be resolved amicably within 15 business days from the date the problems are reported in writing by the USER.
iHunt is not liable for any loss, costs, lawsuits, claims, expenses, or other liabilities caused directly by the violation of the Terms and Conditions.
iHunt is not responsible for damages resulting from the non-functioning of the Site or from the inability to access certain links published on the Site.
Please note that any complaints regarding aesthetic deficiencies of the products will only be considered and analyzed if reported within the first 48 hours from the moment of product reception.
Payment methods for completing an online order are:
- cash on delivery,
- online with a bank card,
- bank transfer to account RO07INGB0000999904875326 (please specify the desired product in the Payment Details section),
- installment payment via mobilpay with: CardAvantaj, Alpha Card, BRD Finance, Bt Star, Bonus Card - Banca Transilvania, Garanti Bank, and Credit Europe. Payment in installments can be made in 3 or 6 installments.
- payment via online credit with Cetelem. If you choose to pay online with a bank card, please note that payment registration does not guarantee order confirmation and delivery. If the order is not confirmed (the order processing time is 48 hours), the amount paid will be refunded to your account as soon as possible. In the case of orders finalized with the payment method "Payment via online credit with Cetelem," please note that we will confirm the order before approving the credit contract, and the fiscal invoice is necessary for the file analysis, but the product delivery will be made within 1-2 business days from the approval of the credit contract. By choosing this payment method, you expressly consent to BNP Paribas Personal Finance S.A. Paris Branch Bucharest (str. Clucerului nr. 78-80, sector 1, Bucharest, J40/20815/2017, CUI 38627806) processing your personal data filled in the form (including Personal Identification Number), directly or through its designated operators, for the purpose of conducting legal relations created/will be created between the parties, respectively for the purpose of conducting credit activities (including querying the Credit Bureau database). Refusal to process your data from the mandatory fields of the form may result in the impossibility of processing your request. You are guaranteed the right to information, access to data, intervention, opposition, the right not to be subject to an individual decision, which you can exercise through a written request (dated and signed) sent to the Cetelem headquarters, as well as the right to address the ANSPDCP in case of violation of the rights guaranteed by Law 677/2001. BNP Paribas Personal Finance S.A. Paris Branch Bucharest has notified ANSPDCP of personal data processing for credit activities (with number 694) and marketing activities (with number 500).*

5.5. Order registration does not represent its confirmation/acceptance. After the order is taken, it will be processed by our operators for confirmation and delivery details. The delivery time is 1-2 business days from order confirmation.
5.6. During Easter, winter holidays, Black Friday event, as well as throughout other company campaigns, order processing and delivery may take between 7-10 business days.
5.7. Please check the integrity and content of the package upon receipt in the presence of the courier. Any subsequent complaints regarding the integrity of the package or the product will not be considered.

5. Accessing the ihunt.ro SITE
Involves the USERS' acceptance for their personal data to be stored and processed by iHunt company. The purposes of processing this data are: creating a database for informing about iHunt promotions or any other promotions or activities carried out by iHunt through any means of communication (mail, email, phone, SMS, etc.), informing USERS about their Account status, including validation, shipment, and billing of orders, solving cancellations or any problems related to an order, goods, and/or services purchased.
iHunt Technology Import Export S.A. is the sole holder of the information collected from this site. iHunt Technology Import Export S.A. undertakes not to disclose personal data to third parties through sale, partial disclosure, or rental. The only exceptions to this rule are the transport operators, the billing program, the telephony operator managing the iHunt switchboard, the electronic messaging distributor, the financial institutions involved in providing the financing solution application service. They perform specific actions agreed upon by iHunt, based on a Non-Disclosure Agreement (NDA) and a contract, documents validated by the Legal Department.

6. Data Collection - is done by completing the data in the Account creation and/or Order form; the USER declares and unconditionally accepts that their personal data will be included in the iHunt database and expressly and unequivocally agrees that all this personal data will be stored, used, and processed for the purpose mentioned above in point 5.

7. Restricted Access and (Un)subscription - there are areas on the site that require registration (see Registration) or subscription (see newsletter). In the case of the newsletter, each edition/alert contains the unsubscription method; once this option is accessed, the unsubscription applies immediately, without requiring further confirmation from the users. Depending on the type of registration (site account creation, newsletter subscription), the user may be asked for data such as: name, surname, email, address, Personal Identification Number, etc. This data is used for identification, validation, or completion of the subscriber's account, invoice, transport note, or application for obtaining a financial solution.

8. Cookies - the ihunt.ro site uses cookies, which are data stored on the user's hard drive, containing information about the user. The use of the cookie mechanism is an advantage for the visitors, as it allows the memorization of browsing options on the site, such as the language in which the site is displayed, the type of filters applied to display certain pages, remembering the username and password for quick access to the site's content. Rejecting a cookie does not mean that the user will be denied access to browsing the site or reading its content. With cookies, site owners can monitor and segment users' interests in certain areas or applications of the site, which subsequently allows them to improve the browsing experience, introduce relevant content for the user, etc. Some of our business partners use cookies on our site, such as those who advertise. However, we do not have access to these cookies, nor can we control them.

9. Links - this site contains links to other sites. iHunt Technology Import Export S.A. is not responsible for the privacy policy practiced by these sites. We recommend consulting the legal terms and other information regarding the collection of personal information beforehand. The rules set out in this text apply only to information collected on this site.

10. Notifications and Actions Regarding User Information - at the written request of the users, dated and signed, sent to the iHunt.

headquarters, iHunt agrees:
a) to confirm to applicants whether they process personal data or not; this is done free of charge.
b) to rectify, update, block, delete, or transform into anonymous data, free of charge, data whose processing does not comply with the provisions of Law No. 677/2001 on the protection of individuals concerning the processing of personal data and the free movement of such data;
c) to cease processing the user's personal data if requested to do so by the user.

11. Communication of Changes If a user's identifying information changes (such as postal code) or if a user wishes to unsubscribe from our services, we will ensure that we correct, update, or delete the personal data entrusted to us by the user. This communication can be done by email at info@ihunt.ro or in writing and sent to the iHunt address.
Any change to the terms of this policy will be communicated to users via email so that they are always informed about the information we collect, how we use it, and under what circumstances, if any, we disclose it. Users will be able to agree or disagree with the use of information for other purposes. We will use the information in accordance with the policy under which the information was collected.

12. Security This site adopts all necessary security measures to protect the personal information of our users. When completing personal data on our site, the information will be protected both offline and online. All personal information will be processed through secure pages using SSL encryption, marked with a padlock symbol.
By agreeing to this "Privacy Policy" document, users fully assume any possible risks.
